thats what I thought at first, solicitor says Id win an appeal easy if I went not guilty and they found me guilty.... the thing is, Id go a year without my driving liscence while its all getting sorted :(

glad it worked out for ya. sucks that it ever got that far though..
Career, Wife, Mortgage... my sig was better when it listed guitars and PC's and stuff!

Ah right that is downright bloody wrong. I wonder though - if you spent a year without your licence and therefore lost out on potential earnings (which Im sure you would and so would many other people - eg taxi driver/bus driver) then could you sue for lost earning? And if you can - who do you sue, the CPS?

lol, dont know, dont care anymore :D

wasn;t origonally going to... but Ive decided to put a big ass clame in for breaking my leg :)

little odd that I have to sue my own companie but what the hell might as well :)
(any money I get comes out of my employers liability insurance!)

accident, broken leg, pulled out by firemen, air lifted to hospital, opperation, metal bar in leg, 10 days in hospital, 26 weeks off work, plus im getting the pins holding the bar in taken out again.....

so fingers crossed its worth a few quid which will make up for the 4 points :)

No considering if your appealing, the DVLA suspend any actions against your licence, you dont even get the points until the appeal decision goes through.

My mate (the same one I talk about earlier in here) got charged with careless driving, appealed, informed the DVLA that she appealed, and got told that theyve removed the points and she can use her licence as she wishes until the result from the appeal judgement is made.

Dude if you wrote the the newspapers and the bbc you will be on tv and papers easy with them taking the piss out of them for that.

You want to do the sun first really since they have a "wouldnt make it up" things, like how councils costign them £100 a tree to take down all the conkers and lay them on the floor so they dont fall and hit people on the head.

Trust us mate, thats a load of bullcrap

i know its crap really... but at least its over and done with and out of the way, didn;t really think I was that bothered about it, but I had the best nights sleep last night that Ive had for a long time :o)

Will it not increase your insurance premium if you successfully claim against your own companys insurance?

On another note, the courts decision sucks nuts :(

^^ nope, employers liability insurance isn;t alowed to work like that :)

its law that every employer must have it, so there no no-clames discount or anything like that, and it doesent matter how many clames you put in, the cost is spread out accross everyone :)  

...tho if the industry your in has a lot of clames then it will go up :(

its just over 3k a year at the moment anyway, so its about time i got something out of it !

the companies been going just over 100 years and hasnt made a clame yet :o

What are you claiming damages for?

As according to the court, you were responsible for the accident due to careless driving.

"I was driving my van carelessly one day, and got hit by a motorcyclist, I sued my employer and got £25,000 in damages".

It just doesnt make sense, the judgement in a court of law, says you are responsible for the accident, there was no fault with the delivery vehicle.

nope, the court accepted the accident was his fault, but the prosecution was saying I was at fault too (only a little bit tho), and I cant prove I wasnt...

if they thought the accident was my fault Id have been done for "death by dangerous driving" and been given a lot more than 4 points !

careless driving is the minimum offence I could be prosecuted for :o

as for calming damages.... I was injured while driving for the company as per my job description.

if you get hurt while your working, then your insured (its the law that you have to have employers liability insurance)
